A pretens\u00e3o deduzida nestes autos tem origem em fatos que remontam a triste per\u00edodo da historia brasileira, per\u00edodo em que vigia o Ato Institucional n\u00ba 5, instrumento de for\u00e7a bruta anti \u2013 democr\u00e1tica; for\u00e7a bruta que atropelou a dignidade das institui\u00e7\u00f5es e a ordem constitucional .<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #29303b;\"><span style=\"font-family: Times New Roman; font-size: small;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #800000;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">7. O autoritarismo dos que exerciam o poder desde o golpe de Estado de 1964 estava condicionado a si pr\u00f3prio e afastava qualquer tutela jur\u00eddica que contrariasse a vontade ditatorial, ainda que remanescesse previs\u00e3o constitucional assegurando-a. O <strong>AI n\u00ba 5<\/strong> estabeleceu, no seu artigo 1\u00ba, que a Constitui\u00e7\u00e3o de 24 de janeiro de 1967 seria mantida com as modifica\u00e7\u00f5es dele constantes.<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #29303b;\"><span style=\"font-family: Times New Roman; font-size: small;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><strong><span style=\"color: #800000;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">Sepultou-se a Constitui\u00e7\u00e3o.<\/span><\/span><\/span><\/strong><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #29303b;\"><span style=\"font-family: Times New Roman; font-size: small;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #800000;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">8 . Somente em 1978 sobreveio a Emenda Constitucional n\u00ba 11, operando a revoga\u00e7\u00e3o dos atos institucionais, ressalvados, no entanto, os efeitos dos atos praticados na sua vig\u00eancia, que permaneciam exclu\u00eddos de aprecia\u00e7\u00e3o pelo Poder Judici\u00e1rio.<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #29303b;\"><span style=\"font-family: Times New Roman; font-size: small;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\"><span style=\"color: #800000;\">. Passo, por fim, \u00e0 analise do pedido de ressarcimento por danos morais. \u00c9 ineg\u00e1vel o direito \u00e0 indeniza\u00e7\u00e3o. Conforme demonstrado na inicial, o autor, por for\u00e7a de procedimento administrativo arbitr\u00e1rio, que culminou em decreto nulo, porquanto suprida a assinatura do Presidente da Republica por falsifica\u00e7\u00e3o grosseira, \u00e9 obrigado a conviver, desde 1.969, com o estima de \u201ccassado\u201d.<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #29303b;\"><span style=\"font-family: Times New Roman; font-size: small;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\"><span style=\"color: #800000;\">. Perfeitamente not\u00f3rias, pois, as agruras e conflitos \u00edntimos pelos quais o autor tem passado nesses anos, suportando o peso de reforma compuls\u00f3ria <strong>que destruiu sua brilhante carreira militar<\/strong>.<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #29303b;\"><span style=\"font-family: Times New Roman; font-size: small;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\"><strong><span style=\"color: #800000;\">PEDIDOS DE ESCLARECIMENTOS<\/span><\/strong><span style=\"color: #800000;\">:<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #800000;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">Senhor Presidente, a meu ver, o preceito do art. 9\u00ba do Ato das Disposi\u00e7\u00f5es Constitucionais Transit\u00f3rias, encerra uma verdadeira exce\u00e7\u00e3o: a \u00fanica interpreta\u00e7\u00e3o poss\u00edvel \u00e9 a estrita. <strong>Descabe<\/strong> a ampliativa ou <strong>a restritiva<\/strong>, porque, alfim, <strong>n\u00e3o se restringe<\/strong> <strong>o que<\/strong> <strong>est\u00e1 na norma.<\/strong><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #29303b;\"><span style=\"font-family: Times New Roman; font-size: small;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\"><span style=\"color: #800000;\">( &#8230; )<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #800000;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">Acompanho Sua Excel\u00eancia, estarrecido, porque, naquela \u00e9poca, <strong>tida como uma \u00e9poca de trevas<\/strong>, houve a cassa\u00e7\u00e3o de um duque.<strong> <\/strong><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #29303b;\"><span style=\"font-family: Times New Roman; font-size: small;\"> <\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; Indo al\u00e9m da Emenda Constitucional n\u00ba 26 de 1985, assegurou no caso de militares atingidos por ato de exce\u00e7\u00e3o desde 1946 e que se acham em inatividade acesso ao posto ou gradua\u00e7\u00e3o a que teria direito se tivesse permanecido na ativa obedecidos prazos de perman\u00eancia em atividade conforme as regras regulamentares vigentes. A reserva de lei \u2013 analisada sob <strong>tal perspectiva<\/strong> \u2013 constitui postulado revestido de fun\u00e7\u00e3o excludente, de car\u00e1ter negativo, pois veda, nas mat\u00e9rias a ela sujeitas, quaisquer interven\u00e7\u00f5es normativas, a titulo prim\u00e1rio, de \u00f3rg\u00e3os estatais n\u00e3o-legislativos. Nenhum ato regulamentar pode criar obriga\u00e7\u00f5es ou restringir direitos, sob pena de incidir em dom\u00ednio constitucionalmente reservado ao \u00e2mbito de atua\u00e7\u00e3o material da lei em sentido formal. Ou seja, que se aplique o principio, mutatis mutandis, \u201cin dubio, pr\u00f3<\/span><\/span><\/strong><span style=\"text-decoration: underline;\"><span style=\"color: #800000;\">&#8211;<\/span><\/span><strong><span style=\"color: #800000;\">anistia<\/span><\/strong><strong><span style=\"text-decoration: underline;\"><span style=\"color: #800000;\">\u201d. <\/span><\/span><\/strong><\/span><\/span><\/p>\n<p style=\"line-height: 15.6pt; margin-right: 3.75pt; text-align: justify;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\"><span style=\"color: #800000;\">II) O segundo ponto que destaco, agora para divergir em parte do parecer (<strong>no sentido exatamente de dar a interpreta\u00e7\u00e3o mais favor\u00e1vel aos destinat\u00e1rios da norma)<\/strong> \u00e9 a abordagem feita sobre o dispositivo que trata da concess\u00e3o da <\/span><strong><span style=\"color: #800000;\">anistia<\/span><\/strong><span style=\"color: #800000;\"> em caso da \u201cmotiva\u00e7\u00e3o pol\u00edtica devidamente comprovada\u201d.<\/span><\/span><\/span><\/p>\n<p style=\"margin: 5pt 3.75pt; line-height: 15.6pt; text-align: justify;\">\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #800000;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">Entendo que a referida hip\u00f3tese, contida no Inciso III, do art 1\u00ba, da Lei de <strong>Anistia<\/strong>, contempla hip\u00f3tese aut\u00f4noma, diversa das outras, de fundamento de ofensa \u00e0 Lei, seja a Constitucional, seja a ordin\u00e1ria, sejam as cl\u00e1usulas de acordo ou conven\u00e7\u00e3o coletiva de trabalho (\u201cleis\u201d entre as partes). <\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #800000;\"><br \/>\n<span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">Bem por isso, entendo que o parecer n\u00e3o pode limitar a leitura do que seja \u201cmotiva\u00e7\u00e3o pol\u00edtica\u201d ao arcabou\u00e7o jur\u00eddico p\u00e1trio vigente, ou a abuso ou desvio de poder por parte da autoridade que praticou os atos depois objeto de <strong>anistia<\/strong>. <\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"color: #800000;\"><br \/>\n<span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">A uma, porque nada est\u00e1 na lei por acaso. E se a \u201cmotiva\u00e7\u00e3o pol\u00edtica\u201d tivesse de ser buscada no \u00e2mbito do descumprimento das normas existentes, n\u00e3o seria necess\u00e1rio o inciso pr\u00f3prio que trata dela. Bastariam aqueles que tratam da ofensa ao ordenamento jur\u00eddico vigente.<\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 0pt; line-height: 15.6pt; text-align: justify;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\"><span style=\"color: #800000;\">A duas, porque sendo aut\u00f4noma a hip\u00f3tese e n\u00e3o sendo ela decorrente do arcabou\u00e7o jur\u00eddico pr\u00e9-existente, s\u00f3 pode ser ela entendida no sentido de que a Lei reconheceu que houve atos de desligamentos fundados em a\u00e7\u00e3o persecut\u00f3ria de natureza ideol\u00f3gica, pol\u00edtica e ou partid\u00e1ria, independente do ato ter sido LEGAL OU N\u00c3O. Ou seja, mesmo o ato LEGAL de desligamento pode ser objeto de <\/span><strong><span style=\"color: #800000;\">anistia<\/span><\/strong><span style=\"color: #800000;\">, uma vez comprovada a \u201cmotiva\u00e7\u00e3o pol\u00edtica\u201d para a sua pr\u00e1tica. <\/span><\/span><\/span><\/p>\n<p style=\"line-height: 15.6pt; margin-right: 3.75pt; text-align: justify;\"><span style=\"color: #800000;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">Repito na hip\u00f3tese: mesmo que o ato do desligamento tenha tido suporte na legisla\u00e7\u00e3o p\u00e1tria e convencional, n\u00e3o se sustentar\u00e1, desde que eivado de natureza de persegui\u00e7\u00e3o ideol\u00f3gica ou pol\u00edtica ou partid\u00e1ria. <\/span><\/span><\/span><\/p>\n<p style=\"line-height: 15.6pt; margin-right: 3.75pt; text-align: justify;\"><span style=\"color: #800000;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\">Por sua vez, na an\u00e1lise e julgamento deste fundamento, o Poder Executivo, atrav\u00e9s da CEI, \u00c9 O EXCLUSIVO JUIZ DESTE JULGAMENTO. <\/span><\/span><\/span><\/p>\n<p style=\"line-height: 15.6pt; margin-right: 3.75pt; text-align: justify;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\"><span style=\"color: #800000;\">Quero dizer, se determinado ato ou fato for entendido como motiva\u00e7\u00e3o pol\u00edtica pelo \u00f3rg\u00e3o competente, no \u00e2mbito do Poder Executivo, como DETERMINADO PELA LEI, e n\u00e3o sendo motiva\u00e7\u00e3o pol\u00edtica elemento encontr\u00e1vel e definido na legisla\u00e7\u00e3o, <strong>N\u00c3O COMPETE<\/strong> AO PODER JUDICIARIO E OU <strong><span style=\"text-decoration: underline;\">AOS \u00d3RG\u00c3OS DE CONTROLE COMO O TRIBUNAL DE CONTAS DA UNI\u00c3O<\/span><\/strong> OU A CONTROLADORIA-GERAL DA UNI\u00c3O <strong><span style=\"text-decoration: underline;\">REVER O M\u00c9RITO DESSE JULGAMENTO<\/span><\/strong><\/span><span style=\"color: #800000;\">. <\/span><\/span><\/span><\/p>\n<p style=\"line-height: 15.6pt; margin-right: 3.75pt; text-align: justify;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\"><span style=\"color: #800000;\">Podem os \u00f3rg\u00e3os de controle e o Poder Judici\u00e1rio verificar os aspectos de ordem formal; por exemplo, se a demiss\u00e3o se deu dentro do prazo a que a lei deferiu as anistias; se n\u00e3o houve justa causa ou outra causa para a demiss\u00e3o, desligamento etc. <\/span><\/span><\/span><\/p>\n<p style=\"line-height: 15.6pt; margin-right: 3.75pt; text-align: justify;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\"><strong><span style=\"text-decoration: underline;\"><span style=\"color: #800000;\">Por conseq\u00fc\u00eancia, n\u00e3o compete \u00e0s Consultorias Jur\u00eddicas dos Minist\u00e9rios<\/span><\/span><\/strong><span style=\"color: #800000;\">, em especial a CONJUR do Minist\u00e9rio do Planejamento, Or\u00e7amento e Gest\u00e3o e mesmo a pr\u00f3pria AGU ou o pr\u00f3prio Advogado-Geral da Uni\u00e3o <strong><span style=\"text-decoration: underline;\">opinar, avaliar ou decidir sobre o que seja ou n\u00e3o seja em cada caso concreto \u201cmotiva\u00e7\u00e3o pol\u00edtica\u201d.<\/span><\/strong><\/span><\/span><\/span><\/p>\n<p style=\"margin-bottom: 12pt; line-height: 15.6pt; text-align: justify;\"><span style=\"font-size: small;\"><span style=\"font-family: Times New Roman;\"><span style=\"color: #800000;\">III) Por \u00faltimo, destaco que as autoridades julgadoras dos pedidos de <\/span><strong><span style=\"color: #800000;\">anistia<\/span><\/strong><span style=\"color: #800000;\"> poder\u00e3o deferi-la, desde que presentes os requisitos da Lei da <\/span><strong><span style=\"color: #800000;\">Anistia<\/span><\/strong><span style=\"color: #800000;\">, mesmo quando o fundamento do pedido formulado for diverso daquele que embasa a<\/span><span style=\"color: #800000;\"> <\/span><span style=\"color: #800000;\">decis\u00e3o do \u00f3rg\u00e3o julgador do pedido. <\/span><\/span><\/span><\/p>\n<p style=\"margin-bottom: 12pt;
