Isso porque, sob o pretexto de &#8216;&#8221;modernizar e unificar&#8221; as regras que disciplinavam o MS, a nova lei traz em seu texto um sem n\u00famero de artigos de constitucionalidade duvidosa, e outros tantos de inconstitucionalidade gritante. At\u00e9 pelo tempo decorrido de sua edi\u00e7\u00e3o, e do breve espa\u00e7o dispon\u00edvel, nos limitaremos a analisar, em curtas linhas, alguns aspectos pol\u00eamicos atinentes \u00e0 liminar no MS.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">Salta aos olhos, ainda que em r\u00e1pida leitura da lei, mesmo aos que o fa\u00e7am desprovidos de grande aten\u00e7\u00e3o, que um dos &#8220;pilares&#8221; da altera\u00e7\u00e3o foi a medida liminar, anteriormente disciplinada no inciso II, do art. 7\u00ba, da lei 1.533\/51 <span style=\"font-size: xx-small;\">(<\/span><a id=\"LS$popup\" onclick=\"jan = window.open('http:\/\/www.planalto.gov.br\/Ccivil_03\/Leis\/L1533.htm', 'popup0', 'toolbar=no,location=no,directories=no,status=no,menubar=no,top=40,left=40, scrollbars=yes,resizable=yes,menubar=no,width=650,height=450'); if (jan != null) { jan.location.href = 'http:\/\/www.planalto.gov.br\/Ccivil_03\/Leis\/L1533.htm' } return false; \" target=\"_self\"><strong><span style=\"font-family: Verdana; color: #000000; font-size: xx-small;\">clique aqui<\/span><\/strong><\/a><span style=\"font-size: xx-small;\">)<\/span>. Tratam do tema o art. 7\u00ba, III, \u00a7\u00a7 1\u00ba, 2\u00ba, 3\u00ba, 4\u00ba e 5\u00ba, arts. 8\u00ba, 9\u00ba, 15\u00ba, dentre outros.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">Em clara contram\u00e3o a tudo o que tem sido feito pelos estudiosos em busca da t\u00e3o sonhada efetividade processual, garantia constitucional derivada da converg\u00eancia entre os princ\u00edpios do devido processo legal e da inafastabilidade do controle jurisdicional, a lei 12.016, em mais de uma oportunidade, impede ou dificulta a concess\u00e3o de medida liminar no mandado de seguran\u00e7a.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">Tomemos por exemplo o disposto no art. 7\u00ba, III, e \u00a7 2\u00ba. O inciso III disp\u00f5e que o juiz poder\u00e1 &#8220;exigir do impetrante cau\u00e7\u00e3o, fian\u00e7a ou dep\u00f3sito, com o objetivo de assegurar o ressarcimento \u00e0 pessoa jur\u00eddica&#8221;. Poder-se-ia argumentar no sentido de, sendo faculdade, a exig\u00eancia da garantia estaria vinculada ao entendimento de cada magistrado, em sua esfera de liberdade de interpreta\u00e7\u00e3o. \u00c9 verdade, mas n\u00e3o deixa de ser um sinal, um &#8220;aperitivo&#8221; do que vem adiante. E o que vem adiante, por exemplo, pode ser constatado no \u00a7 2\u00ba do citado art. 7\u00ba, que veda, pro\u00edbe, de forma expressa, a concess\u00e3o de liminar nas hip\u00f3teses relacionadas<strong><sup>1<\/sup><\/strong>. <\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">Sem discutir cada uma das hip\u00f3teses proibitivas, resta clara a inten\u00e7\u00e3o do legislador: impedir a concess\u00e3o de medida liminar. Isso, por si s\u00f3, \u00e9 suficiente para eivar de clara inconstitucionalidade a disposi\u00e7\u00e3o. Inconstitucionalidade por viola\u00e7\u00e3o ao devido processo legal e \u00e0 inafastabilidade do controle jurisdicional.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">Com efeito, o chamado <strong>acesso \u00e0 ordem jur\u00eddica justa<sup>2<\/sup><\/strong> decorre da converg\u00eancia dos princ\u00edpios do <strong>devido processo legal e da inafastabilidade do controle jurisdicional.<\/strong> Destarte, ressalvadas as peculiaridades de cada caso concreto, a converg\u00eancia daqueles princ\u00edpios visa assegurar a todos os jurisdicionados: acesso ao Poder Judici\u00e1rio, objetivando a prote\u00e7\u00e3o de um direito amea\u00e7ado (tutela preventiva) ou violado (tutela reparat\u00f3ria), com todas as garantias inerentes ao processo, como a possibilidade de ver sua causa julgada por um juiz independente e imparcial, de compet\u00eancia previamente definida em lei, com decis\u00e3o devidamente motivada, com ampla publicidade, e, ainda, podendo as partes exercer o contradit\u00f3rio e a ampla defesa, com todos os meios e recursos a ela inerentes, sendo vedada a utiliza\u00e7\u00e3o de provas ilicitamente obtidas, tendo as partes tratamento substancialmente igualit\u00e1rio. Por fim, a observ\u00e2ncia de todas as garantias acima citadas visa gerar seguran\u00e7a jur\u00eddica, que, no entanto, deve manter-se equilibrada com o princ\u00edpio da efetividade processual, ou seja, a busca pela seguran\u00e7a n\u00e3o deve retirar de uma decis\u00e3o judicial o que ela deve ter de mais precioso: sua capacidade de gerar efeitos no mundo emp\u00edrico, de provocar mudan\u00e7as na vida das partes.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">Se uma norma, qualquer que seja ela, bem como a justificativa de sua edi\u00e7\u00e3o, impede ou dificulta, de qualquer forma, a prola\u00e7\u00e3o de medidas antecipat\u00f3rias, especialmente as liminares, resta claro que afronta diretamente princ\u00edpios estatu\u00eddos na Constitui\u00e7\u00e3o Federal <span style=\"font-size: xx-small;\">(<\/span><a id=\"LS$popup\" onclick=\"jan = window.open('http:\/\/www.planalto.gov.br\/ccivil_03\/constituicao\/Constitui\u00e7ao_Compilado.htm', 'popup0', 'toolbar=no,location=no,directories=no,status=no,menubar=no,top=40,left=40, scrollbars=yes,resizable=yes,menubar=no,width=650,height=450'); if (jan != null) { jan.location.href = 'http:\/\/www.planalto.gov.br\/ccivil_03\/constituicao\/Constitui\u00e7ao_Compilado.htm' } return false; \" target=\"_self\"><strong><span style=\"color: #000000; font-size: xx-small;\">clique aqui<\/span><\/strong><\/a><span style=\"font-size: xx-small;\">)<\/span>, em especial o previsto no art. 5\u00ba, XXXV, da Carta Magna, que traduz a inafastabilidade do controle jurisdicional, pois retira do Poder Judici\u00e1rio a possibilidade de apreciar uma les\u00e3o <strong>ou amea\u00e7a a direito<\/strong>.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\"> N\u00e3o se pode perder de vista, que referidas normas impeditivas de concess\u00e3o de liminares afrontam tamb\u00e9m o princ\u00edpio da separa\u00e7\u00e3o dos poderes, vez que o enunciado normativo representa clara interfer\u00eancia do poder legislativo na esfera de atua\u00e7\u00e3o do poder judici\u00e1rio. <\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">Nesse diapas\u00e3o, ao editar uma norma impeditiva de concess\u00e3o de medidas antecipat\u00f3rias, sejam elas quais forem, de natureza cautelar ou satisfativa, o legislador sobrep\u00f5e-se ao juiz, sem qualquer sorte de pudor, substituindo-o na tarefa jurisdicional. Com efeito, somente o magistrado, imbu\u00eddo de seu poder jurisdicional e baseado na lei, pode dizer quando \u00e9 cab\u00edvel a prola\u00e7\u00e3o de uma medida antecipat\u00f3ria, restando vedado ao legislador a substitui\u00e7\u00e3o<strong><sup>3<\/sup><\/strong>. Nesses casos, evidente a viola\u00e7\u00e3o ao princ\u00edpio da separa\u00e7\u00e3o de Poderes, j\u00e1 que o legislador se adianta ao juiz e afirma, in abstrato, que naquelas hip\u00f3teses definidas pela norma \u00e9 proibida a concess\u00e3o de medidas antecipat\u00f3rias.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">Em disposi\u00e7\u00e3o sub-rept\u00edcia, o disposto no citado \u00a7 2\u00ba acaba complementando a veda\u00e7\u00e3o, ao dispor que: &#8220;\u00a7 5\u00ba As veda\u00e7\u00f5es relacionadas com a concess\u00e3o de liminares previstas neste artigo se estendem \u00e0 tutela antecipada a que se referem os arts. 273 e 461 da lei 5.869, de 11 de janeiro de 1973 &#8211; CPC<strong><em> <\/em><\/strong><span style=\"font-size: xx-small;\">(<\/span><a id=\"LS$popup\" onclick=\"jan = window.open('http:\/\/www.planalto.gov.br\/CCIVIL\/Leis\/L5869.htm', 'popup1', 'toolbar=no,location=no,directories=no,status=no,menubar=no,top=40,left=40, scrollbars=yes,resizable=yes,menubar=no,width=650,height=450'); if (jan != null) { jan.location.href = 'http:\/\/www.planalto.gov.br\/CCIVIL\/Leis\/L5869.htm' } return false; \" target=\"_self\"><span style=\"color: #000000; font-size: xx-small;\"><strong>clique aqui<\/strong><\/span><\/a><span style=\"font-size: xx-small;\">)<\/span>.&#8221;<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">Compondo o arsenal de afrontas, o \u00a7 2\u00ba do art. 22, disp\u00f5e que: <\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<blockquote style=\"margin-right: 0px;\" dir=\"ltr\">\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">&#8220;\u00a7 2\u00ba No mandado de seguran\u00e7a coletivo, a liminar s\u00f3 poder\u00e1 ser concedida ap\u00f3s a audi\u00eancia do representante judicial da pessoa jur\u00eddica de direito p\u00fablico, que dever\u00e1 se pronunciar no prazo de 72 (setenta e duas) horas.&#8221;<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<\/blockquote>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">Com todo respeito, qual o fundamento da exig\u00eancia? Ali\u00e1s, qual a diferen\u00e7a, que n\u00e3o a legitimidade, entre o MS em sua forma individual e sua forma coletiva? Os efeitos? Talvez, mas o fato \u00e9 que n\u00e3o h\u00e1 diferen\u00e7a de ess\u00eancia, sendo as hip\u00f3teses de cabimento exatamente as mesmas, ato ilegal ou abusivo praticado por autoridade coatora, tal qual os requisitos para concess\u00e3o da liminar. Em ambos os casos, individual ou coletivo, h\u00e1 necessidade de direito l\u00edquido e certo, o que significa, de forma simples, prova pr\u00e9-constitu\u00edda, cabal, do direito alegado, vez que n\u00e3o h\u00e1 dila\u00e7\u00e3o probat\u00f3ria. A exig\u00eancia, portanto, \u00e9 inconstitucional, al\u00e9m dos fundamentos j\u00e1 expostos, tamb\u00e9m por criar uma diferencia\u00e7\u00e3o indevida, desarrazoada, ainda mais se levarmos em conta que o par\u00e1grafo fala apenas em &#8220;pessoa jur\u00eddica de direito p\u00fablico&#8221;, sendo cedi\u00e7o que o mandado de seguran\u00e7a pode ser pleiteado em face de outras autoridades diversas.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\" align=\"justify\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana; font-size: x-small;\"><span style=\"font-family: Verdana;\"><span style=\"font-size: x-small;\">S\u00e3o breves coment\u00e1rios, apenas dedicados a observar quest\u00f5es referentes \u00e0 liminar na nova Lei do Mandado de Seguran\u00e7a, de forma a estimular o debate. <\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n<h5 class=\"MsoNormal\" style=\"margin: 0cm 0cm 10pt;\"><span style=\"font-size: xx-small;\"><span style=\"font-family: Verdana;
